Bombay HC lets 60 SpiceJet employees join work from April 1: Subject to final orders

As relief, the Bombay high court has directed SpiceJet to first let 60 employees join work from 1st April in an interim order. The compliance report has to be submitted on 12th April.

According to TOI report, the employees cited a January order of the Industrial tribunal to reinstate services of almost 400 employees whose services were terminated despite a status quo order.

The airline has said their services had come to an end as the fixed duration of their contract had come to an end.

The Chairman and Managing Director SpiceJet, Ajay Singh had approached the Bombay High Court to challenge the Tribunal’s order of reinstatement.

The company’s counsel Kiran Bapat on March 23 submitted an affidavit before a bench of Justice A S Gadkari setting out a list of employees who could join work from April 1.

Jaiprakash Sawant counsel for India SpiceJet Staff and Employees Association said they will attend work from April 1 and the HC accepted his statement, but said their joining of work would be “subject to final outcome of the present petition.’’

In the month of January, HC had said that no new contractual employees or personnel be deployed by any agency till February 8.

SpiceJet has also been asked to submit the list of all the employees on February 5 who were so appointed under the Fixed Term Contract basis for over two to ten years so that the work would be provided to them on a seniority basis and in any case without employing the contract workers in their place.
